The California Department of Fair Employment and Housing (DFEH) has said all employees must be trained in the 2019 calendar year to comply with January 1, 2020, deadline — which means that all employees who trained in 2018 or before must retrain in 2019.
Effective January 2019 Gov. Code 12950.1 (Amended by SB 1343) now requires that all employers of 5 or more employees provide 1 hour of sexual harassment and abusive conduct prevention training to non-managerial employees and 2 hours of sexual harassment and abusive conduct prevention training to managerial employees once every two years.
Senate Bill 1300 Expanded Harassment Definition bill broadened the legal definition of harassment as well as the employer's obligation to prevent it. For instance, a single incident of harassment is now sufficient to bring a hostile-work-environment claim if the conduct unreasonably interfered with the worker's performance or created an intimidating, hostile or offensive working environment. |
